Deputies from the Polk County Sheriff's Office arrested three men during three separate incidents at one Davenport bar Thursday evening, February 20, 2025.
The deputies responded to the bar at about 10:24 pm, after a firearm disturbance was reported at the Wheelhouse Bar at 42637 US 27 in the Deer Creek Crossings plaza.
Upon arrival, they learned that a confrontation between patrons took place, and during that interaction, one of the men pointed a gun at the other man.
During the investigation, another bar patron interfered with deputies numerous times, even after they warned him that he was violating the state's HALO law which provides a 25-foot buffer for first responders to work in. After a final warning, the man began to walk away, but turned back around and began arguing with deputies again, and he was taken into custody.
A third bar patron was acting belligerent with bar staff, and they requested that a deputy trespass the man from the establishment. The man left the bar, but a deputy saw him return through a back door about 25 minutes later. He was taken into custody.
Deputies arrested all three men and took them to the Polk County Jail.
40-year old Carlos Boria Rivera of Polk City was charged with: aggravated assault with a deadly weapon, carrying a concealed weapon in a prohibited area, possession of cocaine and drug paraphernalia, and battery.
49-year old Brandon Weaver of Davenport was charged with resisting.
36-year old Luis Colon Gaud of Davenport was charged with battery on a LEO (2-counts), resisting with violence, resisting without violence, trespassing, and disorderly intoxication.
